If your child has been identified as having a disability that affects their learning, you have entered a world filled with acronyms and legal language. But here is what many parents do not realize: you are one of the most powerful advocates in the room. The law is on your side.
Your Child Has the Right to a Free Appropriate Public Education
Under IDEA, every child with a qualifying disability has the right to a free appropriate public education. This means the school must provide services your child needs at no cost to you, tailored to meet their unique needs.
You Are an Equal Member of the IEP Team
IDEA requires that parents be included as equal members of the IEP team. You have the right to be notified of meetings in advance, attend all IEP meetings, bring a support person, and request meetings at any time during the school year.
You Have the Right to Review All Records
You have the right to inspect and review all educational records related to your child, including evaluations, progress reports, and the IEP itself. Schools must provide copies when requested.
You Can Disagree with the IEP
You are not required to sign an IEP you disagree with. You can provide written notice of disagreement while still consenting to other services. If disputes cannot be resolved, you have the right to request mediation or file a formal complaint.
